The basis is Art. 4 of the EU Copyright Directive 2019/790 (in Germany § 44b UrhG); for works available online the reservation must be machine-readable. Exactly which form suffices (robots.txt, terms of use, protocols such as TDMRep) is the subject of ongoing court cases. Under the AI Act, providers of general-purpose models must have a policy to respect such reservations.
